These Terms & Conditions ("Terms") govern your use of all services provided by Eternal Technology through eternaltech.dev, eternalhost.in (Eternal Host), and eternalcdn.in (Eternal CDN). By accessing or using our services, you agree to be bound by these Terms.
1. Definitions
- "We", "Us", "Our" refers to Eternal Technology.
- "You", "User", "Client" refers to any individual or entity using our services.
- "Services" refers to all products, software, hosting, media CDN, and custom development services offered by Eternal Technology.
- "Platform" refers to our websites and applications collectively.
2. Eligibility
- You must be at least 18 years of age to use our services.
- By using our services, you represent that you have the legal capacity to enter into a binding agreement.
- If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- Notify us immediately if you suspect unauthorized access to your account.
4. Software Products & Licenses
- Digital products purchased from eternaltech.dev are licensed, not sold.
- Each license is valid for the number of domains/installations specified at purchase.
- You may not redistribute, resell, sublicense, or share license keys.
- Reverse engineering, decompiling, or modifying our software is prohibited.
- We reserve the right to revoke licenses that violate these Terms.
5. Custom Development Services
- Project scope, deliverables, timelines, and payment terms will be defined in a separate agreement or proposal.
- Intellectual property rights transfer to the client only after full payment unless otherwise agreed.
- We reserve the right to showcase completed work in our portfolio unless a non disclosure agreement is in place.
- Delays caused by the client (delayed feedback, content, or approvals) may extend project timelines.
6. Web Hosting Services (Eternal Host)
- Hosting services are provided on a subscription basis (monthly, quarterly, or annual).
- We strive for maximum uptime but do not guarantee 100% availability.
- You are responsible for maintaining backups of your data. We provide automated backups as a convenience, not a guarantee.
- We reserve the right to suspend or terminate accounts that violate our Acceptable Use Policy.
6.1 Acceptable Use Policy (Hosting)
You agree not to use our hosting services to:
- Host illegal content or engage in illegal activities.
- Distribute malware, spam, or phishing content.
- Conduct activities that consume excessive server resources affecting other users.
- Host adult content, gambling, or content promoting violence.
- Attempt to gain unauthorized access to other systems or accounts.
- Run cryptocurrency mining software.
7. Media CDN Services (Eternal CDN)
- Eternal CDN provides media storage, optimization, and CDN delivery services.
- You retain ownership of all content you upload.
- You grant us a limited license to process, optimize, cache, and deliver your content as part of the service.
- You are responsible for ensuring that uploaded content does not violate any copyright, trademark, or other intellectual property rights.
- We may remove content that violates these Terms without prior notice.
- Storage and bandwidth limits are defined by your subscription plan.
8. Payments & Billing
- All prices are listed in Indian Rupees (INR) unless otherwise stated.
- Payments are processed securely through Razorpay.
- Applicable taxes (GST) will be added to the listed price.
- Subscription services auto renew unless cancelled before the renewal date.
- Failed payment attempts may result in service suspension after a 3 day grace period.
- Refunds are governed by our Refund & Cancellation Policy.
9. Intellectual Property
- All content, trademarks, logos, software, and materials on our platforms are the property of Eternal Technology unless otherwise stated.
- You may not copy, reproduce, distribute, or create derivative works from our proprietary content without written permission.
- User generated content uploaded to our platforms remains your intellectual property.
10. Privacy
Your use of our services is also governed by our Privacy Policy. We collect, process, and protect your personal data in accordance with applicable data protection laws.
11. Limitation of Liability
- Our services are provided "as is" without warranties of any kind, express or implied.
- We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.
- Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.
- We are not responsible for data loss. You are responsible for maintaining your own backups.
12. Indemnification
You agree to indemnify and hold harmless Eternal Technology, its team members, and affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
13. Termination
- We may suspend or terminate your account if you violate these Terms.
- You may close your account at any time by contacting us.
- Upon termination, your right to use our services ceases immediately.
- Data retention after termination is governed by our Privacy Policy and applicable laws.
14. Dispute Resolution
- These Terms are governed by the laws of India.
- Any disputes shall first be attempted to be resolved through good faith negotiation.
- If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in India.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after changes constitutes your acceptance of the new Terms.
